## Key Louisiana law referenced on this site

- Modified comparative fault (La. Civ. Code art. 2323, as amended by Acts 2025 No. 15, effective January 1, 2026): a claimant 51% or more at fault recovers nothing; below 51% damages are reduced in proportion to fault. This replaced Louisiana's former pure comparative fault rule.
- Direct action against an insurer (La. R.S. 22:1269, as amended by Act 275 of 2024, effective August 1, 2024): the general right to sue a tortfeasor's liability insurer directly was removed. Direct action now requires a statutory exception such as insolvency, bankruptcy, inability to serve the insured, death of the insured, a claim against a family member, an uninsured motorist claim, or a coverage denial or reservation of rights.
- Seat belt evidence (La. R.S. 32:295.1(E)): REPEALED effective January 1, 2021. Evidence of seat belt non-use is no longer statutorily barred in civil cases.
- No Pay, No Play (La. R.S. 32:866, as amended effective August 1, 2025): thresholds raised from $15,000 to $100,000 for bodily injury and from $25,000 to $100,000 for property damage.
- Prescription (La. Civ. Code art. 3493.1): two years for most personal injury claims arising on or after July 1, 2024; one year for earlier claims.
- Wrongful death and survival actions (La. Civ. Code arts. 2315.1 and 2315.2): two distinct claims with a statutory order of beneficiaries, generally one year from the date of death.
- Minimum auto liability limits: 15/30/25.
