What are the seatbelt laws?

Does the federal government regulate seatbelts? You betcha! Here are a few of their awesome regs for your perusal: 1. Federal Seat Belt Regulation 49 CFR Part 392.16: Requires all commercial vehicle drivers to wear a seat belt when operating on public roads. 2. Federal Motor Vehicle Safety Standard No. 208 (FMVSS 208): Requires automotive manufacturers to install seat belts in all seating positions in the vehicle. 3. FMVSS No. 209: Establishes requirements for the design, construction, and performance of seat belt assemblies. 4. FMVSS No. 210: Specifies requirements for seat belt assembly anchorages to ensure their effective performance during a collision. 5. FMVSS No. 213: Specifies requirements for child restraint systems used in motor vehicles. 6. Title 23 Code of Federal Regulations (CFR) Part 1205 – Federal Grant Program for Increasing Seat Belt Use State Programs: Encourages states to enact and enforce seat belt laws and promote educational programs. 7. FMVSS No. 225: Establishes requirements for child restraint anchorage systems to ensure child safety seats can be easily installed and can reliably stay attached during an accident. 8. Federal Railroad Administration Regulation 49 CFR Part 238 – Passenger Equipment Safety Standards: Requires seat belts for crewmembers on locomotives and other selected passenger cars. In Louisiana, you are required by law to wear a seatbelt.  If you get into an accident and are not wearing one, the insurance company can bring that up in court.  Sad! Seriously, it will make your case that much more difficult to win so please wear your seatbelt.

Wrongful Death Lawyer

What is a wrongful death? The phrase “wrongful death” is a civil law term meaning that the person’s death was caused by the fault of another party. An action for wrongful death can arise in a car wreck, by a defective product or by medical negligence just to name a few potential causes of action. Wrongful death is a legal term used to describe a situation where someone dies as a result of the wrongful or negligent actions of another party. Wrongful death lawsuits are typically brought by the surviving family members of the deceased person, and are intended to compensate them for the losses they have suffered as a result of the death. Wrongful death can occur in a variety of circumstances, including car accidents, medical malpractice, defective products, and workplace accidents. To prove a wrongful death claim, the plaintiff (i.e. the surviving family members) must typically show that: The death was caused, in whole or in part, by the actions of the defendantThe defendant was negligent, reckless, or intentionally caused the death, and the plaintiff suffered damages as a result of the death. How are family members compensated? Damages in a wrongful death lawsuit may include compensation for medical expenses, funeral and burial costs, lost income and earning potential, and loss of companionship and support. In some cases, punitive damages may also be awarded to punish the defendant for particularly egregious conduct. Wrongful death lawsuits can be complex, and require the assistance of an experienced personal injury attorney.  An attorney can help the surviving family members to navigate the legal process, gather evidence to support their claim, and negotiate with insurance companies and other parties involved in the case. If you or your family member have suffered personal injuries in a Covington car accident, you may be entitled to compensation.  I am a Covington car accident attorney who can advise you of your rights if you have been injured by in a car crash. We can help you with the insurance claims process if you qualify, and take steps to preserve your rights so that you can focus on your medical treatment and getting better. I have experience in a variety of personal injury matters including motor vehicle accidents, 18 wheeler wrecks, wrongful death claims and defective product litigation. If you or your loved one has been hurt by another person’s negligence, it is recommended that you speak to a personal injury lawyer to discuss your rights.  Before you accept a quick check from an insurance company, it is recommended that you speak to an attorney with experience in personal injury cases first. Wrongful death cases are emotionally difficult because the person’s relatives have to bring the case on their behalf. I have handled a number of wrongful death cases in my career and each one is difficult and emotionally draining. The damages available to you in a wrongful death case are quite different than those in a typical personal injury claim. First, wrongful death claims generally won’t have future medical costs which are associated with the costs incurred to treat someone who has a serious, debilitating injury that requires regular medical care such as nursing services, home health, prescription meds, and future surgeries. Second, in Louisiana, the law will typically limit the pain and suffereing damages to the amount of time the person survived between the event that caused the injury and when the person died. This is a harsh rule and we strongly object to it. Louisiana juries have often awarded substantial amounts of damages in wrongful death cases only to have them reduced on appeal. The actions for “wrongful death” and “survivorship” are defined in the Louisiana Civil Code. Generally speaking, you only have one year from the date of death to file a lawsuit. Eligible plaintiffs can sue for loss of support, loss of income, pain and suffering among other types of damages. Have you won wrongful death cases? Yes.  I have helped families recover damages for the wrongful death to their loved ones in medical negligence cases. Hire a lawyer experienced in wrongful death and survival actions. SEO (Search Engine Optimization) for lawyers.

It is almost impossible for lawyers to rank on Google using SEO alone. I have spent countless hours learning SEO and all its mysteries.  I even wrote a long, detailed essay on how SEO for personal injury lawyers works. Despite all this learning, what I have experienced is that it is pretty easy to rank for low competition services and businesses.  But almost impossible to rank for ultra-competitive services like personal injury law firms. Do you offer some obscure legal service that nobody else offers?  Well you can probably rank for that.  Do you represent those injured in car wrecks like every other lawyer in the world does? Well, that’s a whole different conversation. I did a keyword search on Wordstream and found this: Keywords   Top of page bid (low range) Top of page bid (high range)    Monthly search volume  Competition lawyers near me 135,000 $3.96 $22.27 LOW attorney at law near me 135,000 $3.96 $22.27 LOW lawyers close to me 135,000 $3.96 $22.27 LOW near me lawyer 135,000 $3.96 $22.27 LOW lawyer near by me 135,000 $3.96 $22.27 LOW lawyers in near me 135,000 $3.96 $22.27 LOW divorce lawyers near me 110,000 $2.38 $21.25 MEDIUM family lawyers near me 110,000 $3.10 $27.80 LOW personal injury lawyer near me 110,000 $48.00 $251.11 LOW family law attorney near me 110,000 $3.10 $27.80 LOW family court lawyers near me 110,000 $3.10 $27.80 LOW family law lawyers near me 110,000 $3.10 $27.80 LOW injury attorney near me 110,000 $48.00 $251.11 LOW family court attorney near me 110,000 $3.10 $27.80 LOW personal injury law firm near me 110,000 $48.00 $251.11 LOW personal lawyers near me 110,000 $48.00 $251.11 LOW family law offices near me 110,000 $3.10 $27.80 LOW lawyer near me for divorce 110,000 $2.38 $21.25 MEDIUM attorney divorce near me 110,000 $2.38 $21.25 MEDIUM personal injury firms near me 110,000 $48.00 $251.11 LOW pi lawyers near me 110,000 $48.00 $251.11 LOW lawyer injury near me 110,000 $48.00 $251.11 LOW attorney’s near me 74,000 $3.84 $20.85 LOW immigration lawyer near me 60,500 $3.20 $18.98 MEDIUM divorce attorney near me 60,500 $2.58 $25.62 MEDIUM Keyword traffic for your practice area plus your city is likely going to be slim.  Even if you write tons of bog articles on “Covington car accident attorney,”  it is nevertheless difficult to reach the first page when someone searches for it. The graph above shows that these phrases are “low competition” meaning, at least theoretically, that it should be much easier for the lawyer’s website to show up on the first page if someone searches for those keywords. Google’s algorithm has no idea if you’re a competent lawyer or not.  It goes by rather dumb metrics such as “domain authority” and backlinks. Domain Authority is directly affected by the quality and number of backlinks.  Google, because they are exceedingly leftwing, considers the Washington Post as a very high authority domain.  Yes, you read that correctly.  The newspaper that spreads disinformation and propaganda is very authoritative to the supercilious folks at Google. But when will WaPo ever link to a personal injury website?  It would have to be an article that appealed to leftwing sensibilities, like migrants being shipped from Texas to New York City have Covid, because the Texas government refused to vaccinate and mask up their staff.  Something like would pique their attention.

How to form a corporation or llc

How do you form an LLC or a corporation? My college degree is in business and I have represented small Louisiana businesses for two decades.  I also write about startups and online businesses on my own startup, Podnah. What kind of work do we handle? We can help you form your corporation and even draft operating and partnership agreements. Forming a corporation might sound complex, but it’s something we can easily help you with. Here are some of the steps we will walk you through: Step 1: Choose a Name for Your Corporation Think of a unique name for your corporation. Make sure it’s not already in use by another business in your state. Check with your state’s business registry or website to see if the name is available. Step 2: Decide on the State of Incorporation Choose the state where you want to incorporate your business. Many people pick the state where they plan to do most of their business, but some states have more favorable laws and tax benefits for corporations. Step 3: Prepare and File Articles of Incorporation Prepare a document called “Articles of Incorporation” (sometimes called a “Certificate of Incorporation” or “Charter”). This document includes important information about your corporation, like its name, address, purpose, and the number of shares of stock you’re authorizing. You’ll need to file this with the appropriate state agency (often the Secretary of State). Step 4: Create Bylaws Write up a set of rules called “Bylaws” that outline how your corporation will be run. These rules cover things like how meetings will be held, how decisions will be made, and the roles of the officers (like the president and treasurer). Step 5: Appoint Directors and Officers Choose people to serve as directors and officers for your corporation. Directors make big decisions, while officers handle day-to-day operations. You can be one of these people or appoint others. Step 6: Issue Stock Certificates If your corporation will have shareholders (people who own part of the company), you’ll need to issue stock certificates to them. These certificates show how much of the company they own. Step 7: Get an Employer Identification Number (EIN) Apply for an EIN from the IRS (Internal Revenue Service). This is like a social security number for your corporation and is needed for tax purposes. You can usually do this online for free. Step 8: Register for State Taxes and Permits Depending on your state and the type of business you’re in, you might need to register for state taxes or get specific permits or licenses. Check with your state’s government website for more information. Step 9: Pay the Required Fees Incorporating usually involves paying some fees. These fees cover things like filing your Articles of Incorporation and getting your EIN. The costs can vary depending on your state. Step 10: Start Doing Business Once you’ve completed all the necessary paperwork and legal requirements, you can start operating your corporation and doing business. Remember, it’s important to follow all the rules and regulations for corporations in your state. You might want to consult with a lawyer or a business advisor to make sure you’ve covered everything correctly. Call 985-888-0640 to speak to an experienced business attorney.
